How to Start the DUI Process in Delaware

The Delaware DUI system involves two agencies: the criminal court and the DMV. Here is what typically happens after an arrest:

  1. You are arrested and a BAC test is administered.
  2. Within 15 days, you attend a DMV hearing. If the officer appears, your license is likely suspended.
  3. At your case review (arraignment), the prosecutor may offer a plea or you proceed to trial.
  4. Your attorney refers you to complete a TASK screening. This five-minute screening determines your level of care based on BAC, criminal history, and substance involved.
  5. You are assigned to education, Level 2 outpatient, or extended treatment.
  6. You enroll at CORAS Wellness Newark and begin your program.
  7. Upon completion, your counselor files your paperwork in the state DUI Tracking system.
  8. You return to the DMV, pay a $250 reinstatement fee, and get your license back.

DUI Program Levels at CORAS Newark

Level 1: DUI Education

For first-time offenders with a BAC under 0.15 and no drug involvement. Consists of 16 hours of instruction. No drug screens required. Most sessions are completed virtually after an in-person orientation. Cost: $400.

Most Level 1 clients avoid license suspension and may have their charge reduced to a reckless alcohol-related offense.

Level 2: DUI Outpatient Treatment

Required when your BAC was 0.15 or above, drugs were involved, or it is a second offense with a BAC at or below your first. Includes 4 individual sessions, 6 group sessions, 2 AA meetings, and 2 drug screens. Must meet the state minimum of 16 hours in a six-week window. Cost: $1,000 plus $35 per drug screen.

The curriculum at CORAS Newark follows the “Driving With Care” evidence-based program, which includes structured lessons, worksheets, and group interaction. DUI groups are completely separate from general outpatient and IOP groups.

Extended Treatment

Required when your BAC on a second offense exceeds your first, drugs are involved on a second offense, or you have three or more DUI charges. This is 27 hours of treatment over a minimum of 12 weeks, with 6 drug screens and 2 AA meetings. Cost: $1,700 plus $35 per drug screen.

If a client in extended treatment shows no clean screens at the midpoint, the counselor can refer them to IOP before completing the DUI program. Completing IOP becomes a condition for DUI discharge in that case.

Insurance and Cost

DUI education and treatment fees are set by the state of Delaware. Costs are fixed regardless of insurance status:

  • Level 1 Education: $400 total
  • Level 2 Outpatient Treatment: $1,000 plus $35 per drug screen (2 required)
  • Extended Treatment: $1,700 plus $35 per drug screen (6 required)

A $50 fee applies for missed sessions or individual appointments. Contact CORAS Newark to ask about payment options.

A Note on Delaware DUI Law

Delaware DUI charges do not expire. There is no longer a 10-year lookback window for repeat offenses. If you pled your first DUI down to a reckless alcohol-related charge and you reoffend, that earlier charge converts back to a DUI. A third DUI in Delaware carries a potential sentence of 90 days to 18 months in prison.

Completing your DUI program on time matters. Judges typically give a six-month window to complete treatment. Missing that deadline can result in a probation violation.

Frequently Asked Questions

What is the TASK screening and how do I get one?

TASK is a Delaware state agency that conducts the initial DUI screening. The screening takes about five minutes and determines your level of care based on your BAC, the substance involved, and your DUI history. Your attorney or the court will refer you to TASK. CORAS Wellness cannot assign your level of care; that comes from the screening result.

Can I do my DUI program online?

Level 1 education is mostly virtual after an in-person orientation at CORAS Newark. Level 2 and extended treatment require in-person group attendance at the Newark location.

What happens if I miss a session?

You are required to complete all sessions to receive a certificate of completion. Missing a session costs $50 and you must make it up. Do not miss sessions if you are on a court deadline.

Does a DUI from years ago still count?

Yes. Delaware eliminated the 10-year lookback window. Any prior DUI, including charges that were reduced to reckless alcohol-related, remain on your record for life and will be counted if you reoffend.

Does CORAS Newark offer Spanish-language DUI groups?

Yes. CORAS Newark runs a Spanish-language DUI group on Wednesdays from 4:00 PM to 6:00 PM.

How long does it take to complete the program?

Level 1 education requires 16 hours and can often be completed within a few weeks. Level 2 outpatient must be completed within six weeks. Extended treatment runs a minimum of 12 weeks.
