How the Delaware DUI Program Works
After a DUI arrest in Delaware, two agencies manage your case: the criminal courts and the DMV. Here is the general process:
- You are arrested. The officer records your BAC or requests a blood draw.
- You attend a DMV hearing within 15 days. If the officer attends, your license is typically suspended.
- At your case review, you may accept a plea or proceed to trial.
- You are referred to TASK for a five-minute Delaware screening. Your BAC, the substance involved, and your DUI history determine your assigned level of care.
- You contact CORAS Millsboro to schedule your intake appointment.
- You complete your assigned program level and pass required drug screens.
- Your counselor submits your completion to the state DUI Tracking system.
- You return to the DMV, pay the reinstatement fee, and restore your driving privileges.
Program Levels at CORAS Millsboro
DUI Education (Level 1)
For first-time offenders with a BAC below 0.15 and no drug involvement. This 16-hour program is delivered mostly virtually after an initial in-person orientation at the Millsboro office. No drug screening required. Most clients at this level do not lose their license and may have their charge reduced.
Level 2: Outpatient Treatment
Required when your BAC was 0.15 or higher on a first offense, drugs were involved, or you have a second DUI with a BAC at or below your first offense. Treatment includes individual sessions, group sessions using the Driving With Care curriculum (approved under Delaware DSAMH standards: https://dhss.delaware.gov/DSAMH/DUI/), 2 AA meetings, and 2 drug screens. The state minimum is 16 hours within six weeks.
Level 2 clients at Millsboro complete a biopsychosocial assessment at intake. If the counselor identifies additional mental health needs, a referral may be made, but participation in other services is up to the client.
Extended Treatment
Required for a second offense with a higher BAC than the first, a drug offense following a prior alcohol DUI, or three or more total DUI charges. Extended treatment is 27 hours over at least 12 weeks with 6 required drug screens.
Clients who reach the halfway point of extended treatment without any clean screens may be referred to IOP. The DUI counselor makes this determination clinically. Completing IOP becomes a condition for finishing the DUI program in those cases.
What to Know Before You Enroll
Sessions are mandatory
You must complete every session to receive a certificate of completion. Missing a group session or individual appointment incurs a fee and must be made up. If a judge gave you a six-month window to complete treatment, do not let missed sessions push you past that deadline.
Delaware DUI charges do not expire
Delaware eliminated the 10-year lookback rule for repeat DUI offenders. Prior charges, including those reduced to reckless alcohol-related, stay on your record permanently and may revert to a DUI if you reoffend. A third DUI in Delaware carries 90 days to 18 months in prison.
Out-of-state clients
If you received your DUI in Delaware but live outside the state, you are generally required to complete your program in your home state. The CORAS DUI director handles these cases individually and can refer you to an appropriate local provider.
Frequently Asked Questions
Is CORAS Millsboro the only DUI provider in Sussex County?
CORAS Wellness is the only location in the CORAS network serving Sussex County for DUI programming. If you live in the Millsboro, Georgetown, Seaford, or Lewes area, the Millsboro location is your closest CORAS option.
Do I have to come in person for every session?
Level 1 education is primarily virtual after your in-person orientation. Level 2 and extended treatment require in-person attendance at the Millsboro location for group sessions.
Does Millsboro offer Spanish-language DUI groups?
Yes. A Spanish-language DUI group meets on Tuesdays from 4:00 PM to 6:00 PM at the Millsboro location.
How is my level of care determined?
Your level is assigned by TASK, a Delaware state agency that conducts your DUI screening. The screening reviews your BAC at the time of arrest, whether the offense involved alcohol or drugs, and your full DUI history. CORAS does not make this determination.
What is the biopsychosocial assessment?
For Level 2 and extended treatment clients, CORAS conducts a biopsychosocial assessment at intake. This is a clinical interview that looks at your history, mental health, and any other factors relevant to your care. If additional needs are identified, a referral may be offered, but it is not required.
Can my attorney help me get placed in a lower level of care?
Most attorneys advise clients to complete the assigned treatment rather than contest it. Completing the program on time typically supports a better outcome in court. Note that prior DUI charges, including reduced ones, do not go away and will affect your assigned level if you reoffend.
